1. Who These Terms Apply To
By visiting vitelyhydration.com, creating an account, or placing an order, you enter into a binding agreement with Vitely Hydration ("Vitely", "we", "us"). If you're purchasing on behalf of a business, you confirm you have authority to bind that business to these terms.
If you disagree with any part of these terms, do not use the site.
2. Our Products
Vitely sells hydrogen water generation devices. Our products are wellness devices — they are not medicines, medical devices, or treatments for any disease or condition. Nothing on this website constitutes medical advice. Consult a qualified physician before use if you have an existing health condition.
Product images on the website are representative. Minor variations in colour or finish between the image and physical product do not constitute a defect.
We reserve the right to discontinue any product or modify specifications without prior notice. If a product you ordered is discontinued before dispatch, we will notify you and issue a full refund.
3. Pricing and Payment
All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you complete checkout.
We accept payments via the methods listed at checkout (UPI, cards, net banking, EMI). Payment is processed by Razorpay or an equivalent PCI-DSS compliant gateway. Vitely does not store your card or banking credentials.
If a payment fails but your bank is charged, the amount will be refunded by your bank within 5–7 business days. Contact us if it takes longer.
4. Orders and Fulfillment
Placing an order constitutes an offer to purchase. The contract between you and Vitely is formed when we send you an order confirmation email. We reserve the right to cancel any order before dispatch — for example, due to pricing errors, stock issues, or suspected fraud — with a full refund issued immediately.
Delivery timelines communicated at checkout are estimates. Vitely is not liable for delays caused by logistics partners, weather events, strikes, or circumstances beyond our control.
Risk of loss passes to you upon handover to the carrier. If a shipment is lost in transit, we will either replace the order or issue a refund after completing a carrier investigation, which typically takes 7–10 business days.
5. Returns, Refunds, and Warranty
Governed by our Return & Refund Policy, which is incorporated into these Terms by reference. The 30-day return window and 365-day replacement warranty are in addition to, not instead of, your statutory rights under the Consumer Protection Act, 2019.
6. Acceptable Use
You agree not to:
- Use the site for any unlawful purpose
- Scrape, crawl, or automate any interaction with vitelyhydration.com without written permission
- Submit false orders, fake reviews, or fraudulent chargebacks
- Attempt to gain unauthorized access to our systems, accounts, or data
- Reproduce, distribute, or commercially exploit any content from this website without written permission
Violation of these terms may result in order cancellation, account termination, and legal action where warranted.
7. Intellectual Property
The Vitely name, logo, product names, website copy, images, and design are owned by or licensed to Vitely Hydration. Nothing on this site grants you any licence to use our intellectual property. You may share product links and publicly available content for personal, non-commercial purposes with attribution.
8. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@vitelyhydration.com if you suspect unauthorized access. We are not liable for losses arising from your failure to secure your credentials.
9. Reviews and User Content
When you submit a review, comment, or any other content to us, you grant Vitely a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display that content for commercial and marketing purposes across any medium. You confirm the content is truthful and does not infringe any third-party rights.
We reserve the right to remove any content that is defamatory, abusive, or false.
10. Limitation of Liability
To the maximum extent permitted by Indian law, Vitely's total liability to you for any claim arising from your use of our products or website shall not exceed the amount you paid for the specific order giving rise to the claim.
We are not liable for indirect, incidental, or consequential losses — including loss of income, data, or goodwill — even if we were advised such losses were possible.
Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.
11. Disclaimers
The website and its content are provided "as is." We do not warrant that the site will be uninterrupted, error-free, or free of viruses. We make no warranty that product results will be identical for every user — individual outcomes vary based on physiology, usage patterns, and water quality.
12. Third-Party Links
Our site may contain links to third-party websites (e.g., research papers, partner brands). We do not control and are not responsible for the content, privacy practices, or accuracy of any third-party site. Linking does not constitute endorsement.
13. Governing Law and Disputes
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of vitelyhydration.com shall first be attempted to be resolved through direct negotiation. If unresolved within 30 days, disputes shall be subject to the jurisdiction of the competent courts in Mumbai, Maharashtra.
For consumer complaints, you may also approach the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
14. Changes to These Terms
We may revise these Terms at any time. Changes take effect upon posting to vitelyhydration.com with an updated effective date. Continued use of the site after changes are posted constitutes your acceptance. Material changes will be communicated via email to registered customers.
